By accessing or using the application, the user agrees to be bound by these Terms and Conditions of Use (“Terms”).

1. Purpose

These Terms define the rules governing access to and use of the Nice Society mobile app (the “App”), which offers a curated selection of places, experiences, and services in Nice and the French Riviera.

2. Access to the App

The App is free of charge and does not require user registration or login.

It is available on iOS and Android platforms, subject to compatibility with the user’s device. Some features may require an active internet connection.

KOSKILL reserves the right to modify, suspend, or permanently remove any or all parts of the App without notice.

3. Content and Editorial Policy

The App features a selection of establishments and experiences chosen by the editorial team based on aesthetic, cultural, experiential, or qualitative criteria.

The content is provided for informational purposes only and is not contractual. KOSKILL makes reasonable efforts to ensure accuracy and updates but cannot guarantee the completeness, real-time accuracy, or availability of the establishments listed.

4. Permitted Use

Users agree to use the App in compliance with applicable laws and these Terms.

In particular, users shall not:

tamper with the technical functioning of the App (e.g., intrusion, data scraping, overload);

use the App for unauthorized commercial purposes;

reproduce, modify, copy, or distribute any content without prior written consent from KOSKILL or the rights holder.

Any misuse may result in denial of access without prior notice.

5. Intellectual Property

All elements contained in the App — including but not limited to texts, descriptions, images, photographs, logos, visual identity, interface design, and audiovisual content — are protected under French and international intellectual property laws.

They are the exclusive property of KOSKILL, the listed establishments, or authorized partners, as applicable.

Any reproduction, adaptation, public display, transmission, extraction, or reuse — whether partial or in full — without prior written permission from the rights holder is strictly prohibited.

If any establishment or rights holder believes that a visual or description concerning them has been used without consent, they may request its removal or correction by contacting KOSKILL at: contact@koskill.fr
KOSKILL commits to addressing such requests in good faith and within a reasonable time.

Failure to enforce any right shall not constitute a waiver of that right.

6. Limitation of Liability

KOSKILL strives to maintain the App's accessibility, reliability, and quality. However, use of the App is at the user’s own risk.

KOSKILL cannot be held liable for:

• errors or omissions in the content;
• temporary or permanent unavailability of the App;
• decisions made by users based on the information provided;
• any direct or indirect damage resulting from use of the App.

7. External Links

The App may contain links to third-party websites or services (e.g., booking, mapping, ticketing, social media).

These external sites are independent from KOSKILL. The company assumes no responsibility for their content, availability, or data policies.

8. Personal Data

The App collects no personal data without the user’s explicit consent.

Some technical or usage data may be collected anonymously for analytical or technical improvement purposes (e.g., device type, session duration, navigation patterns).

When submitting an establishment review, a valid email address is required for authentication and moderation purposes only.
When completing the App feedback form, users may optionally provide contact details and device-related information. All data is used solely for internal improvement and not for marketing.

9. Changes to the Terms

KOSKILL reserves the right to update these Terms at any time. Any modifications will take effect upon publication within the App. Continued use of the App implies acceptance of the most recent version of the Terms.

10. Governing Law and Jurisdiction

These Terms are governed by French law. In the event of a dispute, and if no amicable resolution is reached, jurisdiction shall be given to the Courts of Nice, unless otherwise required by law.
